    30 kes ke tribunal -- Pengguna di Kelantan tuntut ganti rugi air berkarat

    KUALA LUMPUR 27 Ogos - Tribunal Tuntutan Pengguna (TTP) hari ini menerima sebanyak 30 kes yang difailkan oleh para pengguna di Kelantan untuk menuntut ganti rugi ke atas bekalan `air berkarat' di negeri itu.
    Menteri Perdagangan Dalam Negeri dan Hal Ehwal Pengguna, Tan Sri Muhyiddin Yassin berkata, tuntutan kerugian dibuat terhadap syarikat pembekal air, Air Kelantan Sdn. Bhd. (AKSB) di pejabat TTP di Kota Bharu pagi ini.
    ``Saya fikir mereka (pengguna) ada hak untuk bawa kes ini ke mahkamah (tribunal) dan kalau ada asas-asas tentulah tribunal akan membuat keputusan yang adil,'' katanya pada sidang media pasca-Kabinet di sini.
    Pada Isnin lalu, Menteri Besar Kelantan Datuk Nik Abdul Aziz Nik Mat meminta rakyat negeri itu tidak membawa isu air `berkarat' yang dibekalkan oleh AKSB ke TTP sebagai usaha untuk menuntut ganti rugi.
    Menteri Besar itu berkata, tindakan itu tidak boleh menyelesaikan masalah tidak puas hati rakyat kerana ia mungkin berpunca daripada masalah paip lama dan tangki yang sudah berkarat.
    Isu bekalan air berkarat ditimbulkan oleh Pengarah Eksekutif Majlis Tindakan Ekonomi Negara (MTEN), Datuk Mustapa Mohamed Ahad lalu yang mencadangkan isu itu dikemukakan kepada TTP sekiranya rakyat Kelantan tidak berpuas hati terhadap kualiti air yang dibekalkan mengikut Akta Pelindungan Pengguna 1999.
    Menurut Mustapa, lebih 300,000 penduduk negeri itu dikenakan caj yang tidak setimpal dengan kualiti perkhidmatan apabila bekalan sering terputus-putus dan air berwarna kemerah-merahan (seperti warna karat).

    Angry TIDAK PUAS !!!

    We will see, if the people of Kelantan can win the case, I don't see why Selangor can't !! However, I doubt the people of Kelantan will win the case.

    The people of selangor, particularly SJ/USJ will bring PUAS to court once the people from Kelantan have won the case. If not, I'm sure people of Selangor will vote for the oppositions !!

    Awang tidak sabar untuk melihat bagaimana Tribunal Tuntutan Pengguna (TTP) akan mengadili 30 kes `air berkarat' yang dikemukakan oleh para pengguna di Kelantan.

    Jika baju putih yang dihantar ke kedai dobi bertukar warna, tidak sukar untuk membuat keputusan. Tukang dobi kenalah bayar ganti rugi.

    Apa yang disifatkan sebagai `air berkarat' yang diterima oleh sebilangan penduduk Kelantan berupa masalah harian. Berapa kali mereka boleh bawa kepada tribunal?

    Mungkin satu jalan penyelesaian ialah dengan tidak mengenakan apa-apa bayaran terhadap pengguna yang terlibat. Maknanya, selagi syarikat terbabit membekalkan `air berkarat' pengguna tidak payah bayar.

    Mungkin ini akan mendorong pihak yang terlibat itu berusaha bersungguh-sungguh untuk membekalkan air bersih kepada pengguna.

    Dalam pada itu, tertanya-tanya juga Awang kenapa Menteri Besar Kelantan meminta rakyat negeri itu tidak membawa masalah tersebut kepada tribunal.

    Ini bukan isu politik. Ia semata-mata isu hak pengguna. Bayangkan setiap hari anda menerima `air berkarat' dan pakaian bertukar warna!

    So what do you all think?? If the opinion this writer is acceptable, we all should be getting free water from PUAS since their water supplies are as 'karated' as in Kelantan or even worse (or does he only meant that this is only applicable in Kelantan)

    My friends, the 'dalang' behind all these 30 cases of complaints to the tribunal is UMNO.. Sendiwara, the politikus know general election is near and the water issue is deliberately politicised to fish for votes. Do you think the problem will go away once UMNO rules the states? percaya lah! USJ has been BN's safest seat for years and our water supply is no better.

    On a second thought, why not, we, at USJ., do the same and see if our two YBs will be on our side?

    We all know why water issue in Kelantan get the greatest publicity.. in RTM, TV3 and Utusan Malaysia.

    Do you think it'll get the same here ? Remember what happen at one time when NTV7 (the better fair coverage TV) highlighted almost the same issue. Has any VIP's responded or tribunal set up immediately for us ?

    just a point to ponder.

    If we want BN to pay the same priority, may be a little more attention, to our water problem and the many other iisues like the Chinese School shortage, voting in the opposition party, Keadilan, to rule our Selangor state in this coming election may be a better option! Afterall, the politikus have been using us all these while to enrich their pockets, it is our turn now to put them in good use for a change.

    Consider law suit against Puas for dirty water
    AS Toh

    I sympathise with letter writer Tak Puas and other water consumers in the Klang Valley who are at a complete loss over what to do with the dirty tap water problem.

    Though Puas is aware of the prevailing dirty tap water, they contend that this is due to old asbestos cement pipes which are prone to leaks, thus allowing sediments to seep into the pipes, resulting in dirty tap water.

    However, many water consumers are not convinced that the existing old pipes are the cause. In the area where I stay in Petaling Jaya which is about 35 years old, the quality of tap water is still tolerable but it is not so in newer areas like Damansara Utama and Kelana Jaya. Also, other states with the same old pipes are not similarly affected. Why just in the Klang Valley?

    There are standards and rules in Malaysia and the state of Selangor that govern the supply of water to consumers. The more relevant ones are the ‘National Guidelines for Drinking Quality1983' (NGDWQ) issued by the Health Ministry and Selangor’s ‘Water Supply Enactment 1997' (WSE).

    The criteria and standards in NGDWQ were based generally on the World Health Organisation Drinking Water Quality Guidelines, 1982. Amongst other requirements, NGDWQ states: "Drinking water must be clear, colourless and odourless. It must be pleasant to drink and free from all harmful micro-organism, chemical substances and radionucleides in amounts which could constitute a hazard to the health of the consumers."

    Clearly, the present quality of tap water supplied to many areas in the Klang Valley, which is turbid, coloured, staining laundry and unpalatable, does not comply with NGDWQ.

    WSE is the law regulating public water supply in Selangor and Kuala Lumpur. Under WSE, it is mandated that the director of water supply and other officers shall carry out such functions and duties to protect the interests of the consumers in respect of, among others, "the quality of water and the water services provided."

    If consumers experience dirty tap water once in a while, it may be tolerable. But it is unacceptable if it happens on a daily basis as experienced now by many consumers in the

    Klang Valley. There is therefore a total neglect of duty on the part of public officers to provide wholesome water supply to millions of water consumers in the Klang Valley.

    From all the above, it is apparent that Puas has failed to ensure that the water supplied to consumers is wholesome and fit for human consumption. Also, Selangor state authorities have failed to take appropriate actions to ensure that the provisions of WSE are fulfilled by Puas.

    Water is essential to life and can be considered a product or a utility within the ambit of Consumer Protection Act 1999 (CPA) which also gives a consumer a right of redress against a supplier of goods or services that fail to comply with quality standards. Therefore, failure to provide or supply water to the standards required under NGDWQ would render Puas liable to damages in a civil claim under the provisions of the CPA.

    So, consumers like Tak Puas should consider - through consumer or resident associations - taking appropriate actions against Puas as provided for under the CPA.

    No point of us small fry taking PUAS to court.

    My opinion..CASA and USJRA shud be the ones doing it.

    They have the lawyers..they have the resources..not small
    time people like me...

    I did a complete water analysis of water from my house incoming mains supply at a reputable lab..IT costs RM1500 to do it..
    JB & I went on NTV7 to bring up the issue as well.
    Even did a spread on NST Life n times section wz Jeff.
    What do we get..ziltch..

    Even the Health minister was saying at that time..water quality
    is good, according to world standards!

    PUAS took water samples from my house twice..but to date,
    they have not shown me the results..
    My results are still wz me..if anyone wants it..I can email them..

    well, with all this news, PUAS (or i think someone has took over, changed the name, i dunno) is still able to say a lot of clean/healthy water supply.... hmm, are they blind or what?

    pls lah, someone start a fight, and i'll join....

    I'm already all worn out discussing this issue. I believe Satish, after all his lab testing and stuff is also sick and tired.

    Now that uncle Samy has met the Sultan and all that, let's see if the BN government who has taken the water management under its umbrella can do something about it. Or will Megat Junid continue his control via PUAS managing our water. If he does, bloody government is back at it, supporting its cronies!!!

    Yeah, let's start a signature rally and show the p!ss-artists at the helm how frustrated we are!!!!!!
