Fully booked or not, you can get eject the fare passenger under the fine print of the United ticket but you cannot simply bloodied kickass someone out of the plane ride. under the book of law and dignity, it is wrong wrong technically and morally.

I'm talking about the soon-to-be court proceedings of David Dao against united airline. He/his lawyers need to establish facts and evidence regardless of what is the so-called verdict from the public/twitter/facebook/talkshow, etc.

The revelations that the flight wasn't overbooked is a favourable piece of fact and thus urgent court petition is filed to preserve all the flight records to safeguard the evidence.

As the trial judgement is made by members of the jury in class action USA lawsuit, David Doa will win hands down with the final verdict. Flight records from fellow passengers and inhumane dragging with bloodied nose should win sympathy from the trial jury which is chosen from the members of the public.

I often observe people like to press the lift button numerous times while waiting for the lift to arrive at their level !! It seems like they firmly believe by keep on pressing the button a few more times, the lift will arrive faster !!

You can see the above everywhere, from low cost flat to high-end office tower or expensive hotel.

Maybe the above behavior can shed some light to the answer..

Simpleton in OXford definition - A foolish or gullible person.

Simpleton is Urban illustration - A foolish person with lack of intelligence, common sense, and street smarts.

Cockerel who crows aloud flapping his wings like CEO Goliath would be roasted in days to come where his boisterous action and reaction has cost multi millions loss in stock valuation by the United board of directors.

Meanwhile simple folk passenger like David would laughing away to the banks with multi millions USD in suit case.

Just History of David and Goliath where the simple folk would win with just a sling stone. And in many class actions where there were won by simple folk lawyers against Armani or Polo suited corporate attorney. Heck, even a simplecartoon cook could win a US case of counter suit by the plaintiff in just a single sitting for his friend acting just as translator as he had no valid licence to practice law.........against a tall white legal attorney who tried to drag the case for 3 years with numerous sittings including transferring case hearings from Philadelphia to Allentown to frustrate a simpleton folk. All the cook did was to appeal to the learned judge to consider the merit of the case, the subject of injustice where the defendant was bullied due to his ignorance of law in simpleton way which has cost his time , monies and expenses of recovering his outstanding debt. And he had to come all the way to Allentown to hear his case where he had being counter suit to frustrate his effort to recover his monies and avoided being having citation by the court of law if he is not well represented. ( he had wasted thousands each time the case was heard in legal fee in Phialdelphia )

I rest my case where cocky CEO are made by thier action and reaction......not born. Not the fault of parentage.

Airlines realize that a certain percentage of passengers will cancel at the last minute. Therefore, to avoid empty seats, they sell more tickets than their max seats capacity, hoping that just about the right number of passengers show up.

Here is a simple example of overbooking calculations using Binomial distribution model. This is a much simplified calculations used by the airlines when they overbook flights. Airlines use complicated computer mathematical model to factor in various variables to find the right number before deciding on the overbooking scenario.


Let assume that the historical no-show rate for an airline is 5%. For a flight with 220 seats, the airline wants to find how the probability of the number of tickets in relation to overbooking. In short, this airline wants to calculate the probability that more than 220 passengers will show up if overbooking is allowed...

Assume S is the number of seats after overbooking. Since the no-show rate is 5% and the objective is to have a plane with full seats, 0.95 x S=220 and thus S =231.57. Because the number of passengers must be an integer, the maximum seats the airline can allow overbooking is 231.

Next is the find the probability, this can be solved using binomial model.
Assume p is the probability of success (0.95), then (1-p) will be the probability of failure (0.05) in order to get the maximum number of seats booked (231 seats). Factor them into binomial distribution model will give an answer of 2.4% chance that more than 220 passengers will show up.

This means for a flight with 220 passengers, there is a probability of 2.4% that all of the 220 passengers will show up (based on the historical no-show rate of 5%). The airline will be more than happy to sell at max seats of 231 because the sales from extra 11 seats will be able to offset the compensation to the 2.4% which are only 5 passengers onboard. That's why they pick the cheapest fare customers because the compensation is commensurate to their ticket value (apart form the hotel accommodation and cash incentive, if any).
