Sexual harrasment is a serious offence especially it violates the woman dignity and self esteem. And we are talking about oral sex without consent - not just flashing some butts without the pants. Without consent, it could be due to under duress or threats of bodily harm.

Where I have had baca Law sikit sikit, under the Malaysian Penal Code for sex offenders, it should be punishable up to years of imprisonment with whips thrown in as well. 7 days and 7 nights is like a stroll in the park.

my contention was:-

1) male is 63 and female is 49
2) both are adult here to know what is sex
3) the case filed was not for rape/molest
4) he was found guilty for having ORAL SEX (facepalm!...how come we dont have that smiley?)
5) obviously under our beloved law, oral sex is a no no and had to be punished
6) the above obviously show both had mutual sex for some reason things went sour and case was filed for oral sex offense
7) hence as a judge, i know sentencing the poor man a severe punishment is wrong; but he had to punish due to the law
8) verdict; 7 days!

Unconsented sex is Sexual Molestation either with harassment, threats or under duress. And oral sex is defined as SEX where in this case, rape. no?

Unless of course that guy did a Bill Clinton lip talk - " I did not have sex with that woman." ( for the record, that was not an illegal act as it was consensual sex by the White House intern Monica Lewimsky, maybe improbable and immoral for the married sitting President of United States to do it at the Oval Office ).

Dun actually know under what Penal Code he was charged with, therefore I kenot not speculate further. But I can speculake just this - he was not charged with indecent sexual acts as the victim was not charged!

Ccomviction under sexual offences kenot be that light as it is considered too be unfair for the victim and subsequent cases to be followed. Even malicious consented sexual acts from sotomee to karimee is punishable with long sentencing and maybe with black eye pea sumore. Just ask DSAI.

We can speculate but the court of law kenot speculate as people are being charged where juidgement are made and sentences being passed out. It has to be based on circumstancial or material evidence and witnesses.

If there is a change of plead, then other set of law would be applied accordingly whereby from nonconsensual to consensual, the victim has turned into acccessory to immoral act between two unmarried people who are Muslim. it is Khalwat as charged and if th act of mouth is deemed immoral, tambah lagi charge. Each charges would be be given specific days and nights or fines on conviction. Worse - the woman could be charged as soliciting for prostitution deal gone bad.

The court is presided by the Yang Arif Judge who are suppose to hear the submisssion by the prosecution and defendants and dispense fines or candies accordingly.

Even usj.com .my we have several Judges where judgement made include banana fines and jail at the plantation resorts. And offenders are even tagged just like those sex offenders in USA when they are released from the jails.
