    CM and Zing,i think it's the legal clerk who forget to do the check on all utilities.I also made a mistake by engaging my friend lawyer ( just to give him business)while rejecting the lawyer offer by the bank.Even my new shoplot also encounter the same thing where the previous owner did not settle the TNB bill,while trying to to nice by contra the new meter $ to my name .The officer said they will write the cheque to the previous meter owner wheather dead or alive.

    Simple advice on your next property purchase, NEXT TIME DON'T BOTHER whether the previous owner has settled the encumberances or not, just go to the relevant authorities and utilities and told them, "Here is a copy of S&P that I have bought this property from this DATE onwards, please amend your records and bill me from this date, ANYTHING BEFORE that go settle yourself" ... don't bother whether the lawyers do a proper job or not, cheques etc ..... LET THE PREVIOUS OWNER KAUTIM or he/she goes to court .... the KEY DOCUMENT IS YOUR S&P and THE DATE SIGNED, anyone kacau you ... SHOW THEM and SUE THEM !!

    Trouble with Malaysians is that we always try to be nice and "kautim" the "Msian way" ... me, I stop doing that when purchasing big-ticket items or kena police summons, JUST FOLLOW LAW ala Sporean and surprise, surprise, IT WORKS HERE TOO !!!!

    Who signed the dotted lines of the Sales & Purchase agreement- not the clerk!

    And as your legal representation, he should have check everything before signing it. Otherwise , it is the neglience of professional duty. it is like if you being operated on , you surgeon friend say - "oops, Ironman, sorry for my oversight, I forgotten to take out pliers inside your body. You gotta to get another surgeon for another operation. Otherwise, you could be suffering pains and agony.

    Never ask your personal friends to be your legal representation if they are not competent or reliable. There goes for the personal doctor friend who wants to operate you or the cook who wanna to cook for your special girlfriends. It is not just the monies but should things get screwed up, who gets the ma fang? Taht's the trouble with Malaysian - either they are too nice to give the business to Saudara saudari instead of professionalism or competency and said takapalah for the incomplete or unsatisfactory job

    Me - I never ask my firends for business either unless they believe in my professionalism, competency and TASK factor.

    And my friends dont like my business either, as I can be just as mean as Olde Mean Ex Chef. I meant to get what I ask or paid for in black and white or I Yell Ow. Anything less ....I sitirred fried and not shaken.

    Even my friend or saudara dont get my vote of confidence if they kenot deliver in the GE.

    CM,talk is easy,just like the Ct 10 unit i tell the MPSJ that previous owners should pay for the outstanding before i bought over.You know how she answer,"abang kalau tak bayar kita masuk rumah dan lelong you punya barang"

    Itudia! When you paid for the legal representation and you dont get it - that's you who get burnt.
    On the other hand, legally the previous owner should be responsible but from debtors to bankers, TNB to Bandaraya, they would catch hold the easy prey. But when dealing with the system, hardly anyone is sympathetic for those who are ignorant about rules and regulations. They just ikut undang undang aje....

    And baru aje, I was assisting an owner of the shophouse who was charged with unpaid TNB bills where it was compounded with meter tampering sumore. The tenant left and the owner got saman with overdue bills amounted to RM15,000! I reasoned with the TNB fella with over 2 meetings and finally got it 60% discounted rate. Could have gotten more but the owner happy with the outcome as he said other owners with similar problems got the most 20%. Meanwhile , I got paid with white coffee, curry mee and his whole real estate business. Heck, he even change his loyar buruk in cousin relation in one important decision . ( BTW, I did not discourage nor encourage him for doing so. )

    I remembered one forumer was thinking to rent it out to questionable business until after the commentaries in the forum, he decided otherwise. Now it is out ....or rather coming into effect..... Law is there ......just the implementation .......where landlords can be charged and premises tutup and lelong.....

    Sorry to offend you with the unsavoury remark. That's just how I feel and universally, we have this love hate relationship with lawyers. We have lawyer jokes, legal dramas, etc. I'm not alone in this sentiment. But I do apologize profusely if it offended you.

    Here are some of the obstacles I went through :

    My situation was selling the apartment and buying another property. That meant I needed to have savings which I did not. The lawyer clearly warned me of the possible situations I could get myself into ....and I did get myself into those situations. My advice is, if you wanna do the selling and buying, you need to have a trolley of cash to pay this and that.

    Obstacles :
    1. UOB didn't approve my loan because my new place is more than 12 years of no strate title yet. Being a loyal customer with UOB and never made any late payment,
    I was angry bangry. Citibank and Affin also said no. Panic set in. Finally, HSBC said Yes.

    2. Buyer of my Court 9 delayed their loan. They thought taking loan from the government would be easy peasy but it turned out to be quite messy. They opted for
    the banks. One month wasted.

    3. Moving out a small portion of stuff to my new place. Hired lorry. My first concern was warning them not to stick their damn "Lori Sewa" stickers at my new place. I
    will really bludgeon someone who does that. I realized I have stuff ..way too much stuff for a single guy and worst, stuff I don't need...like a frame of 2 Korean
    masks..who the hell needs it... THROW THROW THROW. Had to give deposit to Court 9 to move my stuff out and bring it to new place.

    4. Valuers wanted to see my Court 9. Because I moved out and I sort of thrashed my own place, I had to go back and rearrange whatever mess I made. And valuers
    wanted to value it on a weekday. And by that time, LRT construction started already. It was a nightmare coming back to USJ. But I still had time to go to Apollo
    for the beef noodle.

    5. Lawyers cant proceed with stamping, other legal procedures unless I make payment. Heartless but they had to do what they had to do.

    6. Paid everything. Had to go to MPSJ and MBPJ to pay Cukai Taksiran. Thank god for the vending machines at MPSJ. Cancel electricity at TNB. Pay off maintenance fee
    at Court 9.

    7. Last one. Lawyer said cheque is ready but need to move everything out from my Court 9. Hired Malay lorry as they are prone to not stick their Lori Sewa stickers
    everywhere. But this lorry services was a nightmare. They had no Allen keys. NO screwdriver. Had to use a 10 cent coin to unscrew. I just said "Forget it, just take
    out everything and dont bring to my new place". New owner was there to supervise my moving out everything. When he was satisfied, he only called the lawyer to
    give the green light to bank in the cheque. He's a nice guy though.

    8. I wished I had one last look at my place before I close the door. 12 years in Court 9. Had some good times and bad times. Very mixed emotions. But due to
    hecticness, I skipped that part.

    This is my new place. No Metro, RapidKL buses, motorcyclist exhaust noises and most importantly, no more Nigerians

    Understand how your feel from the lengthy post…

    I experienced worse experience when I sold an apartment about 8 years ago...

    To cut the story short – All legal processes were almost completely done but have to REDO again at the last minute because the strata title was just issued. In other words, all previous legal processes which based on the MOU (memorandum of transfer) when strata title is not ready were not accepted and have to redo based on the newly issued strata title. It took me total 10 months to eventually collect the cheque from the buyer’s financier !!

    I am not in legal profession but many of my relatives are. Being surrounded by them, I know what legal professionals can do to help those who need help.

    Lastly, just my personal opinion – like any profession/business, there is low-end and high-end segment in the legal practice. Lawyers who are really good don’t deal with the intensely competitive property transactions. They are involved in underwriting IPO/M&A/insurance and litigation.

    Lawyers - bankers - transporters - where is a living nightmares for those who move!

    But luckily it is green green grass of condo homes where you are owning a place which is home sweet home.

    I am sure your new premise has more trees, birds and bees than court 9.

    One good yardstick to measure the competency of lawyer is to look at thier staffing and way to avoid the nightmares is to get a real estate agent as lawyers , bankers and transporters wanna to be in the good book of references
