hi guys,

can anyone help me with the laws about working-hours and ovrtime?
1.) what is a rest day ?
if we have a 5 day week, is saturday restday (min. 2 x hourly OT-rate) and sunday public holiday-status (3 x hourly OT-rate) or are sat and sun same status?
2.)if working more then 12 hrs, how is OT regulations or practice ?
8 hrs normal worktime, 4 hrs 1 1/2 x hourly rate and then after 12 hrs how much ??

Rather than go by unsubstantiated comments, I'd suggest you buy some of the books on Malaysian Labour Laws. They are small books (more like booklets) and are very cheap. Explains everything you need to know on how not to run foul of the law (I presume you are an employer). By the way, if your managers don't know anything about labour laws, I don't think you can trust them to be your HR manager.

There's a book which I use called Malaysian Labour Law at your fingertips. I forgot who the author is but shd be able to find it in any bookstore.

I agree with KwChang. I don't do labour law practice. It's good idea to buy a local text on employment law. They are reasonably priced.

One word though. Rest day is not properly defined in law. Some call it 'off day' and thus bypassing the law, particularly when it comes to 'replacement holiday', because employers have to replace a 'rest' day (not off day) that falls on 'national public holiday'. Under the law, a 'rest' day is determined by the employer to give way to shift workers who work on Sundays. We take it for granted that weekends are all 'rest days'. Good luck. ;)
