View Full Version : Lagoon Perdana Apartment delayed!

I'm a purchaser of Lagoon Perdana in Bandar Sunway. I purchased a unit
in Block 8, three to four years ago. This are the final few blocks due
for completion. Until now, it is still pending for completion. I called Talam Corporation Berhad regarding this matter and was attended by a very rude and bad-mannered lady from the customer service deparment. I was told by her that there are some major problems between the Developer and the Sub-cons which causes the delay of Block 8 and few more other blocks.

The worst part is, it's not any of the purchaser's fault but due to the fact that many of us are taking a loan from the bank and we are paying the monthly interest for nothing. I've checked the S & P and it is stated there - completion of the unit will take 3 years from the date of purchase. Mine has already exceeded 3 years coz i bought it on the 27th of January 2002.

According to the sales person when I bought my unit, I was told that the apartment will be completed by year 2002 December. It has been dragged on until now. On numerous occasions, I called to get an explanation from the developer, and again I was told that they are having some problems with the shortage of workers.

I accepted their clarification with deep doubt that it will be completed by March 2003 and true enough it did not. When I called them again , they told me completion has been delayed to June 2003, but now it's already March 2005. I'm in the dark now. I hope someone can tell me what can i do next. It’s a heavy burden to pay monthly interest for no cause. It's has been an
expensive lesson for me, definitely.

In addition to that, the workmanship is really bad. A relative of mine has also bought a unit and her complains of poor labor are endless. Complains such as tiles were not cemented properly, poor finishing on the staircase level, living hall, rooms, wall and etc. I personally went to view other blocks and noticed that there are wall cracks on the building itself. There were also water stain marks on the wall and paint peeling on the exterior of the building. Poor and shabby parking lots and bad security were one complain too many.

I’m not the only buyer having to go through this. In fact, the whole few blocks of delayed completion are at their wits end. Someone who has dealt with these issues, please provide your assistance. Please let me know what can i do? or who can i write the complain to?

Hi, there, I don't think you are the only one. So am I. If I'm not wrong, I still remember one clause in the S&P agreement stating that the developer got to pay some sort of compensation/fine for being late completion.

But for myself, I don't have my S&P with me, and not in Malaysia. So, cannot do it. Probably you can keep me posted me after you try.

You can try to check out the Tribunal for Home Buyers - contact can be found at National House Buyers Association website

Try writing to them. I called them recently and was informed that they meet on Saturdays and they are volunteers who try to help out home buyers who have problems like yours.

Hi mumof2m, yes, you are right. There's a clause in the s & p agreement stating that the developer has to pay the purchaser a compensation. It says if the vendor fails to hand over vacant possession of the said Parcel, to which water and electricity supply are ready for connection to the said Parcel in time, the vendor shall pay "immediately" to the purchaser liquidated damages to be calculated from day to day at the rate of 10% per annum of the purchase price. But, i doubt they gonna pay us full... my cousin who is living in block 1 also didn't get full compensation from the developer last time. :mad:

Hi, there,

Probably it's a good idea to get everyone involved to sign a petition or gather together and file this claim. Then, they will take notice and pay attention.

Here, in UK new built house is only be paid when it is fully handed over and with 10 years housebuilder/developer warranty, the NHBC (Natioanl House Building Council), an independant house regulator.

Myself as a construction industry professional, I feel sad that the purchasers' interest are not well taken care of even by the Government. Especially, when this situation happens.

Not to mention that the quality!!!

For other developers, signing a petition is a good idea but for Talam, i guess it's just a waste of time and effort. All they know is to make sure all of their launching is successful but they couldnt be bothered about the workmanship of the project and whether the project is completed in time or otherwise. I've heard a lot of complaints about this developer only after i bought the Lagoon Perdana apartment. I really regret it very much...! :(
