simedarby sent an appeal to mpsj (to develop the one & only park in Subang Jaya) sometime in 4May 2010...

The appeal hearing is set in mpsj early Nov 2010...mpsj using its "...kuasa arbitrari Majlis." decided only to inform the councillors/adun/jkp/residents on Oct 21...leaving the residents/councillors/adun/jkp etcetc very little time to respond. Bloody little napoleons@work!

mpsj is neglecting what the mentri besar khalid had said a couple of months ago at the last 'Meet the Residents - Subang Ria issue" gathering.
The hell with the principles of LA 21 too!

Do u care enuff about this park? :confused:

If the people of Subang Jaya / USJ cares enough to preserve this last bastion of green lungs for their community, all it takes is a date and a time on one of the weekends for hundreds or thousands of you with the wives and the kids and stand around the park with placards. This is THE BEST TIME to do it coz the elections are coming and they cannot afford to see peaceful residents holding protests like these....

If you want the park preserved, JUST DO IT! Have a huge gargantuan family picnic. :eek:

It is obvious Sime Darby and MPSJ will win this one... nobody in SJ/USJ interested at all in this issue since Lato Tupai brought it up. Well, I don't stay in USJ no more so.... :rolleyes:

It generated enough to have MB coming to Subang to talk about it with Tupai and other froumers jumping to the special meeting months ago. Maybe we just have our handful ( not tied ) with so many protests from telco towel to mega 100 tower from one Empire that has set to the next incoming Vampire at SS15. :( :confused: :(

Me? Happy if there is any protest here or there where people can gather to have party or pinic for I can set up my Kiosk to sell my food and drinks. ;) :D ;)

This is to inform you that YB Hannah and I have managed to discuss this matter with Mr Derek Fernandez and he has consented to assist in the case at the Appeal's Board. He will do it pro-bono ... for which we are really ever so grateful and very appreciative of.

The least we all can do is to:
- assist with incidental and administrative costs involved, if required
- assist in preparation of paper work etc, if required
- make our presence felt at the respective hearings that will take place (first one in on 11th November 2010 - time to be advised)

This morning YB Hannah, SJRA and I managed to meet with Pengarah Perancang and Pengarah Undang-Undang of MPSJ to discuss the matter further for our collective onward action.

I would like to say this ex councillor is not any ordinary retired councillor. She cares enough to contribute her experience and expertise without fears or favors. How often do you see a superwoman flying around like that? For that, I tabik spring to her being such a committed person without seeking rewards and recognitions of whatsoever. :) :cool: :)

Agreed its prime prop.

Ditto is Central Park NY. The founding fathers there had the foresight to make it off limit, to development and gazetted that piece of vvvvv prime estate as a park, for the generations of Nyorkers to enjoy.

Subang Ria used to belong to the state bn govt, admistered under mppj. Thru a bolehland corrupted hantu way, the park title was given to simedarby, in exchange for 9 or thereabout bungalows & semi dees in ss19.

The park is to be a park. with explicit permission to build 'bangunan bangunan utk rekreasi s'ja' ..now SD wanna pusing pusing and develop condos, mixed development, bungalows and semi dees...while retaining a small corner portion (including the unusable tasik) as public park.

Its a statemate for now BUT SlimeDarby is trying various means and ways to get its way...inspite of the MB's assurance that its is not fait accompli yet.

Personally, I blame it on the then barisan state government and the corrupted people running the state and the land office.

Many an Adun past, knew about the hanky panky but equally many tutup 1mata or else adopted 'my hands are tied' merry go round.

We, the residents, are trying to make a diff for our future gen...thats all.

nothing they can do lar.. its private property belonging to sime darby.. regular joggers will tell you car break ins are common, while they are doing their rounds around the lake especially in the morning.... sime darby dont' give two hoots about the users.. just the value of the land

agreed! the land now belongs to slime darby. They can dump rubbish there or hack up the jogging track or let it degenerate to a dumpster and WE CAN DO nutz....even mpsj can do nuts about it.

BUT what we as SJresidents can do is to Object to any commercial development outside of 'bangunan bangunan rekreasi'...and apply thru the legal way, 'local 21' when applied will win, Insyaallah.

Its not a goliath winning over david yet unless, we the small Blur Sotongs of Sjaya and some say USj, allowed it! :eek:

A 'Save Subang Ria Park' fund raising was mooted during the meeting with the Mb, months ago. This fund (i think) will be used amongst other things, as a down payment of sort to 'buy back' the park and hopefully at the same recreational park value, from Sdarby. It was mooted that the subang jaya people show enuff interest (to the state gomen) to wanting to hold onto this park and make the 'token' downpayment,while the state gomen Insyaalah , will pick up the tab and buy back (invoking the land acquisition act)the park.

It was also suggested that the 9 bungalows & semi dees given in exchanged for the park, be revalued at today's rate (with the new owner's permission ~god knows how many hands these properties had gone thru...) and use the new valuation to buy back the park... Something liddat lah. I also dont remmber leow...

Slime Darby is still reeling from the recent controversies of taking humongous financial write-offs and hardly recovered yet. 50 people with placards at Subang Ria or in Jalan Raja Laut HQ would be very shioking and shocking to them, want to do it, do it NOW! :D

How can it be when it is gazetted to be a park, the developer can bulldoze it without the land code approval,licence and building zoning codes?
Undang undang ada tapi ada udang disebalik batu!
BTW, any illegal extension with houses from SS15 to SS17, and some said SS19 too, would have the illegal extensions being torn down and bulldozed away by the council. But why Sime Derby can even race through the finishing line? :confused: :p :confused:

it pays to be rich and powerful...u can break the law, then use money to pay off the puny fine (whats a Rm100,000 when u have Rm10million? or whats Rm10million when u have Rm500million?)... ditto same same with the empire at ss16. Submitted x plan then built x+y storeys...then developer paid puny fine cos apanama also got mamak-jepun bakery there! :eek:

just for your info, Sime Properties has (quietly -- but residents found out) filed an appeal against the MPSJ dis-approval to sub-divide/ develop a portion of the Subang Ria Park for their commercial development.

as such, the subang jaya residents association/jkp zone 1 has filed an intervention appeal to counter sime's action.

The case will be mentioned/heard at the Selangor Appeal Board on:

Date: Nov 11, 2010 (Thursday)
Time: 10am
Lembaga Rayuan Negeri Selangor
18th Floor Bgn Darul Ehsan
No 3 Jalan Indah, Seksyen 14
Shah Alam

If you are able, please do come and join us on Thursday (yes, day after tomorrow!) and lend support to the "Save Subang Ria Park team". Make your presence felt and known that Subang Ria Park must remain a park.

This will be the first of many "hearings" to come at the Appeal Board... the whole process will certainly take time and lots of effort ... and perseverance ... and the absolute need for residents' physical presence!

Meanwhile, as most of you know, we are still waiting for our Mentri Besar/Selangor State Govt to valuate Subang Ria Park vis-a-vis the residents' call to re-acquire the park from Sime Properties.

(For the record, please note the following:
a) the gazetted Local Plan of MPSJ has ensured that the full area of Taman Subang Ria is to remain a park.
b) Mr Derek Fernandez has offered pro-bono legal services to the SJRA to take up this issue at the Selangor Appeal Board.)

I believe Mr Gill - Chairman of SJRA will likely be sending out an appeal for "people support" ... soon ... but in the meantime, this is a personal notification from me ... in the hope that you can try to fit it into your busy schedule to lend support.

pls help preserve Subang Ria Park -- our only green lung -- for our kids and their future generation.

It seems that it is not a Sedih Saga, but the Sombong Saga of Sime Darby to ignore the protests by the MB, Adun, SJ leaders, residents or thesum of all numbers - RAYKAT who wants the land to be what it was presented to be - GREEN. And who ever write the clauses in few separate approvals for under the vague term of commercial use? Building highrise tower - commercial use? having go kart ammusement in the park also commercial use? hell, setting one arm bandit pub also commercial use? :p
If there is a class suit legal action here, I would probably make tons of monies by suing Sime Darby for misleading with intent to cheat as I would filed the contention when I bought the houses then be buying a green land parcel as part of the deal as suggested in the brochure and then then staus of the land.. :p

This is a case of "insulting the intelligence of the Rakyat". After all the work done by the Team who worked with me on the Bantahan of the Draft Local Plan ... where we managed to ensure that certain crucial matters for Subang Jaya and other fundamental planning matters were crystallised ... we have this new wayang where the gazetted Local Plan reflects a set of different details and unfamiliar decisions.

In the event the State Planning Committee intended to change what was agreed upon ... then the document has to be displayed again for public viewing and comments before it is finally gazetted. We will need to take this issue a step further soon.

For now my questions are:
1. Who instructed the State Planning Committee to gazette a document that is incongruent with the written Jawapan from State Planning Committee and MPSJ to the Bantahan-Bantahan to the Draft Local Plan?
2. Who instructed the State Planning Committee to gazette 19 acres of the Subang Ria Park for commercial use ... when it was clearly stated it is a green area?
3. Who instructed the State Planning Committee to reverse the decision of the 10-storeys for new development to 24-storeys?
4. How many versions of the gazetted Local Plan are in circulation?
5. Why is it that from the date it was gazetted till today the Local Plan is still in printing mode for circulation and the Public is unable to purchase a copy for review?

There are many other questions to be raised. Today, WE, the Residents have to fight our own battles collectively. We are unable to rely on outside assistance other than ourselves ... we do not have anyone to turn to ... even those who are elected into power or appointed into positions say they are HELPLESS ... there is a lot of finger pointing. The buck has to stop somewhere. Let us put our heads and hearts together to see how best we can bring about some sanity and integrity to the way things are being done.

Some1 is now asking the elected ADUn hannah to resign over this inability to 'gazette' the park as a green.

If I was still living in USJ/SJ, I would organize the family day at the park, with placards, you bet I will do that!

I have done that to save the playground at USJ4 years ago as a resident with that camping outing, and I sure will do it for Subang Ria, if I am still a resident.

Pls attend a Town hall meeting with MB on 8th Jan, 11(Saturday) at 2:30 pm at SS15 Hall (Next to Market).
We need to fill up the hall to send a strong message to MB to act to preserve the park.

We have to convey a very strong message that we need to preserve Subang RIA Park for the following reasons below.
Facts which many of you must be made aware of
1. This is the ONLY town park for Subang Jaya, Bandar Sunway and USJ. All other townships have their own town parks which are well maintained e.g. Tun Ismail town Park.

2. We were told in all the sales brochures that there is a 76.6 acres town park accessible to all house buyers. One generation of children enjoyed the use of full park facilities in the 80s, and 90s. One generation of children have lost out and all future generations will loose if we allow any non recreational development on our Town Park.

3. We had all the town park facilities in the 80s and 90s which were deliberately destroyed by SIME in a sinister plan to force the residents to agree to them developing commercially on the town park. They have been trying to cheat the residents of our town park since 1997. Once their land bank was used up for houses they want to sell our town park too. Sime has sold playgrounds in SS14, SS15 and even built the North tower of SDMC on the car park to our Subang Ria Park (for those who remember).

4. In 1988 the land title was transferred to Sime-UEP with a condition that the land should be solely for recreational use only. We now know that this transfer was a mistake as mentioned my Selangor Town and Country planning department director Datin Paduka Dr Halimation Saadiah Hashim.


5. Pls note the following figures and you will realise that we will have only water and a jogging track left once the development is completed. Do not fall in Simes trap of a Win-Win situation. There is NO win-win for residents. It will be major LOSE-LOSE for residents if they allow even 1 inch to be converted for commercial development. Look at the facts below(in acres).

We the rakyat have to take our lives back and ensure we leave a Healthy and Sustainable environment for our children and ourselves in our old age. The power to say NO NO NO is in our hands, so exercise this right of saying NO WE DONT WANT ANY NON RECREATIONAL DEVELOPMENT ON OUR SUBANG RIA PARK. We must start saying No any unsustainable and unhealthy development in the future in Subang Jaya, Bandar Sunway and USJ.

I am surprised the opposition to the Sime development plan is so aggressive at the committee level and nothing at the people's level... there should be a "show of force" by a peaceful camping out on a bright breezy Sunday morning, complete with placards objecting to the devt plans. :rolleyes:

How the hell the residents of Subang Jaya gonna raise 1/3 of the value of the (park) land???? :eek:

Subang Jaya might as well change its name to LUBANG JAYA...

For those flying into or out of Perth WA. Next time just take a look out your window - and you get to see sprawling parks within the suburbs and residential areas - in fact, the entire front of CBD facing Swan River - is an esplanade... trees and grass strips...

Oh... I near forgot about King's Park... another huge reserved piece of green lung for the city of Perth... Kita apa ada ??? remnants of Kelapa Sawit fronds and other (pitiful looking) God forsaken Palm trees, sandwiched between road dividers... :(

Whilst the saga continues for the park, for those staying in Putra Heights - can confirm that Sime UEP has 'successfully' cleaned out half (the jungle on) the hill at the entrance of Putra Heights... better they do it now before someone protest... since the monkeys up on that hill cannot! :rolleyes:

Let me guess, "my hands are tied" - yeah, thats the famous patented words of ex-Subang Jaya ADUN Lee Hwa Beng and "over my dead body".... duh... who said that?

Lee Hwa Beng's hands might be tied but his tongue was not - he told my ex-employer that I should stop posting negative comments about him as Greenbug in this forum. Of course, one ball-carrying ass-licker (who is USJ's version of a political frog jumping from MCA to Gerakan to MCA and DAP and still dreaming of being appointed a councillor) told him who Greenbug was!

I am still waiting for the day when I sort this out.... :mad:

Sime Darby as a corporate and responsible developer should not touch Subang Ria Lake. Firstly, lot of people bought into the surrounding areas because of this...a deception..you may call them gullible..

Shame on you Sime Darby, denying the community where you earn your money by denying them 'green living space'.

While nobody can challenge you that you are the title holder, but your devious ways are not admired by many.

Instead, why not make it into a nice place for Subang Jayans and gain the community support? Why not touch them in their heart instead of being the axhole in the community?

SD is making so much losses that it aint funny anymore...compounding the dirty linen being publicly washed...lagi teruk.

So, can we seriously think/hope that this park will stay as a recreational park (with permit to build bangunan rekreasi sja) for ad infinitum?

Then allow public to put some assets into it, thus making it an equal partnership.

It will solve all future headache if the PKR state gomen buy back (under its current title hence lower value) and have it gazetted as a Public Park ala Central Park of NYork lah! or St James' or Hyde Park of London, then no1, insyallah, can touch it...but this is Bolehland, so donno also...

Sime Darby as a corporate and responsible developer should not touch Subang Ria Lake. Firstly, lot of people bought into the surrounding areas because of this...a deception..you may call them gullible..

Shame on you Sime Darby, denying the community where you earn your money by denying them 'green living space'.

well... they've been reclaiming a lot of parks and playgrounds (with the hlep of MPSJ) in Subang Jaya and USJ... still trying to grab land in USJ 6, USJ 11 and as recently as USJ16 - saw a banner that was PROTESTING about MPSJ allowing it to happen... (poster disappeared by the evening... :rolleyes: )

Makes you wonder... no?

Maybe, the Slime Buddy wants to develope the recreational parks with the Malaysian genius book of records with many high ends of state of the arts of toilets for the senior citizens. As one of the largest local conglomerate in bolehland, and after making bbbilions of money from the SJ/USJ folks, the last thing they should do is go against the majority voice here to develop the one and only recreational park.

In fact, those Sin buggers should upgrade the Subang Ria recreational park infrastructure and facilities as a token of appreciation to the folks here who contributed to their past and present success.

Those guys still have an illusion that their properties can sell, and can sell by itself.

Well, just look at the USJ Height and compare it with The Lake Edge (Puchong) by YTL . my dog also know which one is a better deal, and a better house and place to stay.

Not so fast. Sime Darby is not a small company and they have great plans for the Subang Ria Park and here we are talking about multi million ringgit deal. Sime Darby Property planned to develop 250 condominium units and the extension of its medical centre on the 7.7ha piece of land.

They have deep pockets. I expect them to refer this Appeal Board decision for a judicial review in the High Court. If they lose, they still have avenue to the Court of Appeal and finally to the Federal Court. I am sure they don't give up so easily. Until the Federal Court decides in our favour, don't doze off.

Slime Darby is in no position now to fight the people's court ie the court of public perception, it is also a smart company. Having said that, don't count the people shooting themselves in the foot by overturning their own decision when another coalition takes over Selangor State esp the team from "my hands are tied" party.... :rolleyes:

To all Friends of Subang Ria park,

Lembaga Rayuan today rejected Sime's appeal on the grounds that it is recreational land and only recreational related buildings can be constructed. The total 72.6 acres is recreational and MPSJ was right in rejecting their application to build executive houses or Sime Darby medical center suites.

The outcome of this appeal is important as it has bearing on how to move forward. I believe the documents that were provided by SJRA lawyer Derek during the Intervention proceeding helped the panel as all the facts were in those documents. Please look our for news of this judgement in the papers over the next few days.

I take this opportunity to thank Tan Sri Khalid, YB Hannah Yeoh, Derek Fernandez, Mdm Theresa Thong, YB Loh Gwo Burne, Dr Loi, Rajiv, Dato Lee Hwa Beng, MSSJ Ydps(Past) and MPSJ legal team Leader Anita for their unwavering support past and present to preserve the park as 1 piece. I would also like to thank the members of the press for their quality articles which truly reflected the facts and feelings of the residents in regards Subang Ria. Lastly to all you who attended public hearing, dialogues etc Thank you. We still have some ways to go and I hope we will have even more residents involved in the endeavor.
