hi guys,

hope someone in here hv this experience n can advise what can be done.

#friday(21 may) someone knock into the back of my wife's car, she(lady driving, husband n teenage son was also in the car) refused to admit her fault n becomes aggressive. my wife called n informed me so i told wife , cut long story short n not to argue with that family, go to police station n make a report.

police report was made , but the other party(the one that knock into my wife's car) did not make any report.
police say since the other party did not make any report, they can only issue them a summon (RM 1000.00) n we will not be able to claim third party insurrance.

as they had been aggressive in the incident, i m more interested in claiming against them so as to make them lose their NCB.

#as police say , without the other party report, we cannot claim against them.
anyone hv this experience to share?
anyone can assist or advise as to what could be done??

best you go over to the police station and talk to the OC. trafik...

mana ada police cannot take action if the other party no report the accident... bullsh!t...if like that - then if you langgar and someone mati, you don't report - you lepas :confused:

the police just finding excuse to cuci tangan... :rolleyes:

U can always claim against the 3rd party. When the cops issu the banger with a summon, it means the banger is already 'salah'. U hv a case. The banger's particulars will be traced by cops & jpj eventually (when wanna renew r/tax).

Of course lah, where got polis help u with insuran ? U got the car plate ? Go seek advice from the person u bought the insurance from...lest, u go pusing around the roundabout.

ps/ which brings me to duh story about WHY choosing & sticking to 1insurance agent is SO VERY important. ANd that it is the aftersales that matters...and buying from part-timer agent/s or this & that fella will NOT allow u the opp to develop any biz relationship at all...and practically NO 1off or p/time agent will help u in time of need. Que serasera. :cool:

we r trying to ask the police for a copy of the summon, if that is possible, as that seem to be the only thing i could do.

Of course you can claim against the other party's insurance but it is lenghty if the other party do not admit to the accident.

Just file a claim with your insurance company and claim 'knock for knock' go ahead and repair the damages. Furnish your claim with the police report stating that the other party was at fault. Your insurance company will then send a subrogation claim to the other party's insurer (which they can trace via the registration number) In the meantime your NCB 'might' be suspended pending confirmation from the other party.

With the other car's number plate, go to jpj and do an owner details check. The owner's name, address and insurance details would be given. Withthe details contact the third party insurance company.

To claim KFK you do not need the other party's police report, you need only to notify your insurer and furnish them with the necessary details - registration number, accident report and police findings (that you were not at fault)

Your insurance company will then do all the 'leg work' of tracing the other party's insurer and lodging a subrogration claim. In the meantime, your insurer will pay for all the necessary repairs 1st. Whether they are able to claim back the subrogration or not does not effect you or your NCB

Yes your NCB will be suspended but will be released once the police findings is finalised (confirm that you were not at fault)

which insurance r u using, it sound good. if that was the case , it means my insurance is giving me the merry-go-round.

Motor insurance is a tarriffed product i.e. same rules apply to all the players.

I suspect that your agent is giving you the run around as oppose to your insurer.
