Hi,

Just want to seek legal opinion / advise, is email consider legal communication? For example, we have notified our customer vied email that by certain date if we didn't hear from him, we will forfeit his downpayment. Can we use that email as evidence in case he disputed or should we ask a lawyer to send another letter? :confused:

I think the latter is the best soluton.

But if the government can take action against someone's forum posting or even facebook posting... why can't email be used as a legal form of communication too?

How can you proof that the email arrive to its intended mailbox?

How can you proof that person have read the email?

But if you send "emails" (eg Instigating, fraud, etc) and authorities can trace to you then they can nab you.... :D

Sometime, after emailing, I fax over the email and keep the fax confirmation report or send via register mail.

Sorry ah, just wanna throw in another spanner. How would we know that the reply came from the intended person and not someone else who was lurking around when the email was received? Can this be contended? :confused:

In my opinion, one has to responsible for whatever belong to him.
