My friend was slapped with a summon for being a guarantor to someone whom she do not know at all. Her main suspicion was her information was being misuse. This is rather worrying. Is there a way for one to check one's guarantor status? Can the bank enforce its right?

i) Take the summon and go see the bank which issued the summon and state your case. Get them to cancel and withdraw the summon (make sure you get it in black & white) failing which;

ii) make a police report and with a copy of the report and summon, engage a lawyer to send them to the bank concerned and once again demand the cancellation and withdrawal of the summon with a notice you will commence legal action if they fail to do so within a certain period.

This is only if your friend is truly not involved as a guarantor.

Sentinel, Thanks. Is there anything proactive that one can do? As in doing a search on themself to check whether their information been misuse?

I guess a check on bankcruptcy actions should also raise the list of people who are guarantors as well as borrowers. If you have a friend working in credit control in a company, they normally subscribe to this service online where you can key in your name and IC number and wallah! you are WANTED! Just kiddin'....

Your fren should attend court on the summon's mention date or she may become bankrupt soon.

Jadewhite, it is not as easy to make someone bankcrupt as issue a summon and attend a court... just take it easy and do what I told you.

To make someone bankcrupt, there is the letter of demand (summon), failing which the creditor need to apply for a petition and only after that a notice is issued... not easy. Just do what I asked you to do and take it easy....

jadewhite, ask your friend to go to Bank Negara to check his CCRIS then all info will be out!
