Friends, another day with high adrenalin level !!

I kena compound parking early this week despite displaying the ticket in on the dashboard. That blue uniform guy told me that dia tak nampak itu ticket. I believe I had properly placed it on the dashboard. So compound was issued RM80.

Went to MPSJ, that perompuan kata I kena bayar juga itu saman. I showed her the proof of the ticket, valid another 1 hour 4 minutes when the compound was issued. I have paid for the parking, now some more kena saman.

What do u suggest?

I feel like going to court and ask them to proof that my ticket was not visible

If you've absolute proof your ticket is valid..take them to court because they'll do the same thing if you're in the wrong!. Being the authority they are..it DOESN'T mean they're always in the right. Jangan kasi muka!.

I got stuck in similar case with MBPJ years ago. They reduced the compound to RM 10 and I still have to pay.

If you're in the right, you're still being insisted to pay fine (regardless however small the amount)..doesn't make any sense does it?.. mana logik?
Something in the law is certainly WRONG!...cost for the fler walking the streets?, admin fees?, price for the saman sheet?, that fler's time & effort to saman you? or to promote the "Malaysia Boleh" spirit?... Tell me.
That's why its sometimes like this particular case where the LAW is NOT working for or protecting YOU..its the other way around.

Err dear Achee...biasanya...before they wrote you the ticket...they would have to take a picture of the complete windscreen of your cardi(pic showing the license plate also)..as a proof that...NO parking coupon was visible...at the time of their visual checks of the windscreen of your cardi.

Ahem...itu biasanya...but at times they can just plain...buat tak tau...to write you that ticket...even if it was...'Opps...gua tak nampak you punya parking coupon...jadi gua saman sama you lah...'

So...what you need to do is to see the relevant officer in charge at MPSJ...get him or her to show you...the evidence that they have against you...for not displaying the coupon around the windscreen of your car...

If they can't find you that picture(camera rosak kot?)...means they have no evidence against you...except that the officer at the time...made a poor judgement to have issued you with the ticket...unjustifiably.

Each month...there would be a 'mesra rakyat' session organized at MPSJ...to hear of any grouses from the public...hence it would be the right time...that you present your...hujah...to the legal advisory officer on duty...to convince him or her...in order to...strike out their ticket...against you.

Achee... no point arguing with the little guys in blue, walk right in to see the chief and talk to him and I mean talk to him, not negotiate or plead, talk to!

well, I can complain all I want but I still have to pay. I even talked to the the person in charge. My time is even more expensive than the RM 10. If anyone managed to get away from paying the saman in such case, please do enlighten us the proper way. :mad:

The ticket was struck off immediately by the legal advisory officer...during the 'mesra rakyat' session...when Orchi showed...CONCRETE proof that a MONTHLY parking coupon was attached to the windscreen of Orchi's punya...cardi on the day that her officer...decided to go 'buta' when he claimed that he never saw that MONTHLY parking coupon that was stucked on the windscreen of Orchi's punya...cardi.

Oh btw buddies...for your additional infos...the MONTHLY parking coupon is available for sale with MPSJ's counter...at $80 per MONTH...niah.

No time to go? No problem - send your explanation in writing to MBPJ with a copy of the evidence. Of course, be factual and respectful. You could also state where you displayed the receipt.

While it will be easy for the officers to say "still have to pay a minimal amount", it is different if they have to put this in writing.

I received a positive waiver once - for not displaying (or even purchasing) any ticket.

You should not pay a single sen. In fact you should sue them for the loss of your time and expenses in sorting this mess which was created by them in the first place.

why should you pay?? if you are paying, then they can simply issue any compound to any car(s) that paid the parking ticket.
As i know, the one issued the compound will some have commission from the compound that you paid.

In other words..the system is structured in many ways..NOT to one's advantage. Go figure how much cost one may have to spend to contest a RM50 saman. This is the Bolehland we've inherited!

This is the problem with Malaysia. Ah just RM50 only. Pay la. Scare to death about court. Why they want to take you to court in the first place unless you punch the guy on the face and his face turn to a turtle. Don't be afraid to fight got your rights.

Once I sitting in my fren car. I sit at the back. While cruising, a motorcycle policeman stop us. He was alone. He said license pls. I told my fren ask him why he want the license. He did nothing wrong. Than the police said your fren did not wear seat belt (left front passenger). Than he also ask for my fren IC the one who never wear seat belt. Before we completely stop the car, I ask my fren to wear the seat belt quickly. So, I ask my fren not to give anything to the policeman. I told the policeman who said my fren never wear seat belt. Can you see the seat belt is on him?. Then he said I saw from behind just now he is not wearing seat belt. I told him what prove you have?. I said I can be the witness to my fren. He wear seat belt. Then I ask my fren (the driver) did you see he wear seat belt from the moment he seat there. HE also say yes.

Then the policeman say, oh, you want to "Cari Pasal" ha. I said no, we have two witness and you don't have. Normally police petrol need minimum 2 person. The reason is they can be witness for each other. But this policeman came alone. So he got no witness.

After that, he say you want me to call Petrol Car and send you to Balai?. I angry tell him. Are you trying to frighten us?. Do you know we are tax payer. We pay more than 50k per year. Your salary are also paid by us. We pay you to protect us not abuse us. Please respect the uniform that you are wearing. Please don't threaten us!!!.

Than he said you PEGILAH. Jangan Kasi saya tangkap lagi.

I told my fren just drive and don't bother about him.

this is the Citizen right that I inform you guys. I learn this from one of my fren who has just return from USA. He got Green Card in USA now. He told me, US ppl know their rights very well. He open my eyes when he argue with a policeman last time in one incident.

We Malaysian are too weak in knowing our rights. We are too "CHIN CHAI" in everything. Just like when you order Teh Tarik kurang manis. The guy give you normal Teh Tarik which is very sweet. What normally people. Tak apa lah. Minum saja. This is the situation. Why can just ask them to take back and do a new one?. Shy?. Try to be Mr. Nice guy?. You tell me.

Know your right from now.

urging one to know his right and yet what you urged yr friend to do is wrong. do you mean it's your right to manipulate the situation to your benefit and challenge anyone who questions?

Attend the meeting! See the boss! Challenge them in court! etc... I agree that we should stand on principle if we are in the right. But how much time do we have to go thro the above process?

I choose to apply the principle 'we reap what we sow' while standing on principle. In my > 2 decades of driving, I managed to get away from many situations which were 'compoundable' - purely by pleading for forgiveness and, where justifiable, explaining my stand - in BM. Cases of illegal parking, speeding and, in one instance, expiry of road tax for 2 weeks !!! In all case, I have acknowledged my mistake where applicable and asked for forgiveness. Most policemen - even those who ask for 'kopi' - are generally friendly in nature and let me go without giving 'kopi'. Of course, I will accept the summon in the (very) few cases they refuse.

My suggestion to write has also been highly successful. I have numerous cases of waivers or reduced rates (where I was wrong and they must impose a token). I remember a JPJ campaign years ago which resulted in many having to go JPJ to fork out RM300 but I received a RM100 discount - not bad for 10 minutes typing.

Of course, I try to comply with the law wherever possible and do not take the above as a license to do as I like.

It's a lot of work sometimes to fight for one's rights.
Some just do not have the time, or the means, so take the easy way out by just paying if they can afford it. I suspect a number of Malaysians are ignorant of their rights.
I think that is why the general view is that Malaysians are not very "demanding" and easy going. :)

Should we maintain our "docile" image or we fight for what is "right", allllllll.....the way, till we vomit blood :D

Victory can sometimes be sweet (I know because I have tasted it) :cool:
