Anyone familiar with Land Title stuff?

Hi,

I am wondering if there is anyone of you familiar with Malaysia's land title law. I understood yesterday that the Land Office will initially issue the "Hak Milik Sementara" land title. After some time, only will they convert to "Suratan Hak Milik". If you look at it first glance, it is logical, as Land Office might need sometime to get approval and stuff.

But then, I have bought my present house like more than 4 years ago, and the house is actually 7 years old when I bought it. So it means the house is now 11 years old, but still the Land Office is yet to come up with a proper land title?

Is it the norm in Malaysia?

don't quite understand yr prob. is yr house in a housing estate or did you buy the land and build yr own? if so is the land freehold?

Yes, it is a landed property in USJ and I bought a freehold title for a double storey house.

Does anybody know whether the house owner can make a "presentation" themselves to the land office to get them to write the owner's name in the title?
I already have the title (without any owner name on it) and MOT.
Is a lawyer necessary?

We got the land title in Oct 2006 after 6 years from the date of purchase. Please check with your lawyer whom did your S & P when you bought the house. The lawyer should follow-up closely with the land office in order to get the title transferred under your name. To expedite the process, you may go to the land office with your lawyer and necessary documents. My hubby told the land officer that we wanted to sell the house, and we got our title within two weeks’ time. :-)

Thanks for the advice. For me, my issue is diefferent. I have the land title, and it's under my name. But then the land title is only temporary as "Hak Milik Sementara 11AK". But I understand that the real land title should be "Suratan Hak Milik 11A/B".

My title is also a Borang 11AK – Hakmilik Sementara. It indicated “Geran untuk selama-lamanya.” on the document.

I checked with my lawyer just now, and she told me that Borang 11AK was the only title issued by the land office. It would take ages for the land office to issue a Permanent/Final Title to the owner. The land office would not entertain the owner if s/he applies for a PT/FT unless they ask the owner to surrender the Borang 11AK and re-issue a PT/FT to him/her. Therefore, Borang 11AK is a valid title.

But then, EPF requirement is "Borang 11A/B" and not 11AK. I checked with them on the phone, and they told me most probably 11A/B is with the bank. I just went to bank, they said they only have original 11AK as well. But checked with EPF, they said if that's the case, then 11AK can be used.

Anyway, thanks for the advice. I was worried becuase I am having a "temporary" title. Does it mean that they could revoke it, anytime they deem fit?

In Malaysia, temporary can have a very different meaning from that in the Oxford dictionary. :D Note the SJ Temporary Market in SS 15.

sorry don't think you can, those lawyers are endangered species that required state protection. if you can do the transfer document yourself, lawyer all cannot cari makan, so they make the land transfer system really complicated and you have no choice but to pay through your nose to hire a lawyer to do it. lucky bunch of people isn't it ?

it is odd that you have a title but without any owner name on it, it is just not possible you sure it is not a fake one ? just joking...

Maybe the The House Buyers Association can help you. They're a volunteer organisation but their people are extremely expert at explaining and helping out with all sorts of land and house paperwork.
