Can i sue a kindergarden for overcharging - since for the whole month of December they are not operating why do they force me to pay up?

Annoyed!!!

I think not as this is a contract agreed upon when you sign up your kid. Similarly to the school bus service, they will collect for the month of December even though they don't run.

Perhaps somebody should start banning this unreasonable law. Is just so stupid.

Well.... thought I don't support this 'implied' charging law.. but what can we do. This is a contract signed.... you should read carefully before agreeing to the terms. If not agreeable, you shld voice it out or reject to accept and find other nursery.

By the way... mind to share which Kindergarten that gave rise to this issue? :rolleyes:

Probably can go to a "small claims court" if its about few hundred ringgit.. However, look thru the enrolment form / fees structure , you might have signed. Most kinder fees stated included the holidays...

I would say all the Kindergarten practise that unless u are sending your kids for a full day inclusive of the day care. Reason being they still need to pay salary to the teachers. It is important for you to check with the respective kindergarten before u decided to enrol your kids. However, there r some kindergarten don't really follow the gomen school system where there r still classes going on during school holidays like my son's kindergarten only officially closed on 2nd week of December and classes still on during the June school holidays but the school fees is expensive :(

Err...there may be 2 sets of rates...

1. Say 150/month x 12 months(1,800/annum)...would be collected from parents...(1st+last month payable upon enrollment of child)

2. Say 180/month x 10 months(1,800/annum)...would be collected from parents...this way would have less disputes...

Best is to understand clearly from the kindergarten...before parents enroll their childrens...to avoid any misunderstandings later on...

this is not considered as over charge. like the buses service, they rely on school days to make a living. during the month of december, they still have mouth to feed. Teachers still need to pay their bills and stuff, so they still need to get paid, same goes for the bus driver and other related fields. It's only fair.

What if on the month of february due to the holidays and leaves and a shorter month, ur boss tell you to take only half of ur pay cheque? Same thing here! If you can accept that half pay, then i say u have all the right to complaint.

yes. if school bus i can understand. but if its a kindergarden or daycare they should continue to operate during this so called holidays. if not just think where is the logic of paying them during the one month holiday at the same time find someone to pay another babysitter. unless if you are asking me to take 1 month leave which impossible. if you need the money then WORK !!! dunt just close down for JUST BECAUSE reason. (if its 1 week holiday is acceptable ) the situation here is for daycare/kindergarden that charge the whole one mth fee but close down their business. for school bus we can understand that there is no need to go school since is a school holiday. my situation here is for daycare/kindergarden. i think is unethical.

am sure the richer one thinks the opposite though.
